Some documents need witnesses in addition to the notary. A Florida durable power of attorney needs two, all present at the same moment. The notary cannot serve as one of them, and a witness generally cannot be someone named in the document. Witnesses are yours to arrange, and the notary cannot serve as one. Florida does not allow us to bring or provide them, so tell us what the document calls for when you book and nothing is a surprise at the appointment.

A current driver licence, state ID card, US passport, military ID or permanent resident card. It has to be unexpired and it has to have a photo and signature. If a signer has no acceptable ID at all, Florida allows identification through credible witnesses, but that has its own requirements, so call us first.

We are required to confirm the signer understands what they are signing and is doing it of their own free will. If someone is heavily medicated, disoriented, or clearly being pressured, we have to stop. It is not us being difficult - a document signed by someone who could not consent is one a court can set aside later. Where we can, we suggest coming back at a better hour instead.

Choosing a form, explaining what a document means or telling you what to sign is the practice of law, and a notary who offers it is breaking Florida law and putting your document at risk. We verify identity and witness signatures. For anything about the content, speak to an attorney.

We can notarize the self-proving affidavit that typically accompanies a Florida will, which is what most people are actually asking about. We cannot advise on how a will should be drafted, executed or witnessed. That belongs with an estate attorney, and getting it wrong is expensive to fix after the fact.
